Are my rights violated by the first sale doctrine?
I bought a particular fabric, made of cloth with a layette, and put it for sale on eBay. Today I was informed by eBay that the owner of copyright of state I in violation of copyright, and my items was removed. I thought I was safe because the first-sale doctrine / rules first sale / exhaustion rule. Can anyone help me with this?
You will certainly have a valid argument. I suggest you start your research Tabberone's website. He fought for the ability to sell its products made Disney licensed the fabric on eBay. And he won the fight! The link is below. Http: / / www.tabberone.com / Trademarks / trademarks.html his website is excellent, and suggest that read it completely. That being said, if licensor is a large company, my guess is that you are looking for a hard fight against the licensor as well on eBay.
